Virtual challenge
Terms and Conditions

Thank you for signing up to participate in a virtual challenge to raise funds for The Royal Marsden Cancer Charity (Registered Charity No. 1095197) (“RMCC”). These terms and conditions apply to all those taking part in a virtual challenge and by signing up you agree to comply with them.

Fundraising

You agree to take part in this virtual challenge as an independent supporter of RMCC. You will refer to raising money “in aid of” RMCC, rather than on RMCC’s behalf, and RMCC does not accept any responsibility for your virtual challenge (see Liability, below).

You agree that you will comply with any instructions or guidance provided by RMCC relating to this virtual challenge.

You understand that if you are unable to complete this virtual challenge you must ask your sponsors if they would like their donations to be refunded. The donor must request the refund by contacting the RMCC team at fundraising.events@rmh.nhs.uk with the link to their fundraising page and details on the donations that need to be refunded i.e donation amount and donor name.

Proceeds of your fundraising

You agree to pay all of the proceeds raised by your virtual challenge to RMCC as soon as possible after completion, and in accordance with RMCC’s instructions. You may not deduct any costs or expenses unless otherwise agreed with RMCC.

You will comply with any investigations RMCC undertakes if it has grounds for suspecting any misuse or misappropriation of funds. RMCC may take any action it thinks fit to establish that all funds are accounted for correctly.

You will encourage donors and/or sponsors to make gift aid declarations where eligible, which may enable us to recover basic rate tax on such donations. Personal Data

The Royal Marsden Cancer Charity will use the information you have provided to send you a fundraising pack in the post and contact you about your virtual challenge and fundraising.

Your personal information may also be used for the purposes of sending communications to you where you have expressly confirmed that you would like to receive further information about the Charity’s work when registering for this virtual challenge. All personal data held by us will be handled in accordance with the UK’s Data Protection legislation and in accordance with RMCC’s privacy statement which can be found at https://www.royalmarsden.org/privacy 

You agree that, by fundraising for RMCC, you will make yourself aware of and compliant with the UK’s data protection regulation regarding the use, storage and processing of any third-party data you may end up receiving or being in contact with as a result of your fundraising.

Content

If you provide photographs or videos taken during this virtual challenge to RMCC or post any content in relation to this virtual challenge on social media forums, you agree that these may be used by RMCC for commercial and/or fundraising purposes. 

You confirm that if you are an employee of a company that supports The Royal Marsden Cancer Charity you are happy for your photos to be shared with your employer and they may be used for advertising, publications, marketing material and any other documents that may be made available to the public.

By sending such photographs or videos to us, you are also confirming that anyone featuring prominently in any such photograph or video is aged 18 or over, and that they have consented to their image being used in this way. You shouldn’t send photographs of under 18s to us without written permission from the parent or guardian. 

Use of logo and branding

RMCC must consent to any use of its logo, including the in aid of logo, name, branding and other intellectual property rights. All rights and goodwill attaching to our intellectual property rights are, and shall remain, the sole property of RMCC.

You must ensure that whenever RMCC’s in aid of logo is used, it is acknowledged that RMCC’s identity is protected by trademark and copyright law, and that all communications featuring the RMCC brand identity or logo are accompanied by: “The Royal Marsden Cancer Charity. Registered Charity no. 1095197”.

Any fundraising opportunity or condition that requires the use of RMCC’s registered charity number must have prior written approval from RMCC.

Liability

You accept that any risks arising out of your partaking in this virtual challenge are your responsibility, and you must take all reasonable precautions to protect your health and safety. RMCC does not have any responsibility for these matters and will not be liable to you for anything that may occur.

You are confident that you are physically capable of taking part in this virtual challenge. If there is any doubt, you confirm that you will seek medical advice from your GP.

You acknowledge and accept that RMCC’s insurance policy will not cover your partaking in this virtual challenge.

You will not do anything that threatens RMCC’s reputation or name. If you do, RMCC has the right to ask you to stop your fundraising immediately.

If you are under 18 and have registered for this virtual challenge, you must notify RMCC so that we can handle your data appropriately in accordance with the UK GDPR.

If you are under 18, you confirm that you have shown these terms and conditions to your parent/guardian, and they have agreed to accept responsibility for complying with these terms and conditions.

T-shirts

Our fulfilment provider will aim to send t-shirts to all participants by no later than 14 days after the start of the challenge. T-shirts are available while stocks last and will be allocated on a first-come, first-served basis.

Term

Either you or RMCC may bring this Agreement to an end at any time by giving notice in writing to the other. If neither of us has done so three months after the Agreement begins it will automatically come to an end unless you let us know that it should continue. When this Agreement ends you must cease all fundraising activities and return any unused materials we have provided to you.
